The fight over SB 1070 is shaping up to be a legal battle for the ages, and today the American Bar Association joined in the melee.
The ABA submitted an amicus brief to the U.S. District Court in Arizona recommending a preliminary injunction of SB 1070 until the law’s constitutionality can be sorted out in court.
The 27-page brief lays out four aspects of the law that have the ABA concerned — on the top of the list, of course, is the possibility that it could lead to racial profiling by Arizona law enforcement agencies.
The other three areas of concern are: probable mandatory detention of citizens and non-citizens, the increased burden and new obligations on Arizona’s indigent-defense program, and the attempted usurpation of exclusive federal authority to enforce immigration laws.

There are currently 18 pending motions against the new law by multiple plaintiffs, as well as two pending motions to dismiss the lawsuits led by none other than (cue the Darth Vadar music, SB 1070-haters) Pinal County Sheriff Paul Babeu and Maricopa County Sheriff Joe Arpaio.
The law is set to go into effect next month, unless a court enjoins its implementation.
