The latest book in the “we-love-Pat-Tillman” saga, Where Men Win Glory, by John Krakauer, features a photo of the former Arizona Cardinal staring heroically into the distance while standing on top of a mountain in Afghanistan.
It’s enough to make any football fan weep.. One problem — the guy who took the photo claims the book’s publisher, Random House, had no right to use it.
Ed Darack is suing the publisher in a Manhattan federal court for copyright infringement because he claims Random House unilaterally changed the terms of a contract he signed.
Darack, according to Courthouse News, claims that a contract was signed between his subagent, Getty Images, and Random House for the use of the photo in a book that was to be published on November 1, 2013.

According to Darack, after releasing the Krakauer book, Random House changed the date of the sale to October 2009 so it could use the image in that.
Random House did not return our phone call.
Darack is seeking unknown monetary damages from Random House and Doubleday publishing firms.
